Terms of Service

These Terms of Service ("Terms") govern your use of the FamilyPlate AI mobile application and website (the "Service"), provided by FamilyPlate AI ("we," "our," or "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use FamilyPlate AI. By using the Service you represent that you meet this age requirement and that all family members you add are also 16 or older and have consented to use the Service.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@familyplateai.com if you suspect unauthorized use.

You agree to provide accurate information and to keep it up to date.

3. Subscriptions, Free Trial, and Auto-Renewal

Plans

FamilyPlate AI offers monthly and annual auto-renewing subscriptions. Current pricing is shown in the app at the point of purchase. Each household plan includes up to 3 family member profiles.

7-day free trial

New subscribers may receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the price shown when you signed up.

Auto-renewal

Your subscription automatically renews at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your iTunes/Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the renewal price displayed in the App Store.

Managing your subscription

You can manage or cancel your subscription at any time in your iPhone or iPad Settings › [Your Name] › Subscriptions, or directly from inside the FamilyPlate AI app via Settings › Manage Subscription. Cancelling stops future renewals; access to paid features continues through the end of the current billing period.

Refunds

All purchases are processed by Apple. Refunds are governed by Apple's policies. Request refunds at reportaproblem.apple.com.

4. Acceptable Use

You agree not to:

Use the Service in violation of any law or regulation.
Reverse engineer, decompile, or attempt to extract the source code of the Service.
Resell, sublicense, or share your subscription with people outside your household.
Upload content that is unlawful, infringing, defamatory, or harmful.
Interfere with the operation of the Service or with other users.
Use automated tools to scrape or copy nutrition data from the Service.

5. User Content

You retain ownership of the meal photos, recipes, voice recordings, and other content you submit ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, process, and display it as needed to operate the Service for you and your household. We will not use your User Content for advertising.

6. AI-Generated Outputs

FamilyPlate AI uses artificial intelligence to identify ingredients, suggest recipes, and estimate nutrition. AI outputs are estimates and may be inaccurate. You are responsible for reviewing AI suggestions before relying on them, especially for allergen avoidance.

7. Health Disclaimer

FamilyPlate AI is not a medical or healthcare service. The Service is intended for general nutrition tracking and is not a substitute for professional medical, nutritional, or dietary advice, diagnosis, or treatment. Always consult a qualified healthcare professional regarding any medical condition or before making changes to your diet, especially if you or a family member has allergies, food sensitivities, diabetes, an eating disorder, or other health conditions. We are not liable for decisions you make based on information from the Service.

8. Allergen and Nutrition Accuracy

Allergen warnings, nutrition values, and ingredient lists are sourced from third-party databases and AI vision systems and may be incomplete or inaccurate. Always read product packaging and consult a healthcare professional for life-threatening allergies. We disclaim liability for missed or incorrect allergen information.

9. Third-Party Services

The Service integrates with Apple HealthKit, Apple Watch, RingConn, Myzone, and other third-party platforms. Your use of those platforms is governed by their own terms. We are not responsible for third-party services.

10. Intellectual Property

FamilyPlate AI, the FamilyPlate AI logo, and all related software, content, and trademarks are owned by us or our licensors. You receive a limited, revocable, non-exclusive license to use the Service for personal, household use. All rights not expressly granted are reserved.

11. Termination

You may stop using the Service at any time and delete your account from Settings › Account. We may suspend or terminate access to the Service if you violate these Terms or to protect the Service or other users. If we terminate your subscription for cause, you will not receive a refund of unused time.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy of nutrition information, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, in no event will FamilyPlate AI, our affiliates, or our service providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US$50.

14. Indemnification

You agree to defend and indemnify FamilyPlate AI from any claims arising out of your User Content, your violation of these Terms, or your misuse of the Service.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Alabama, USA, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Alabama, and you consent to that jurisdiction. Where allowed by law, you and FamilyPlate AI waive any right to a jury trial.

16. Apple-Specific Terms

You acknowledge that these Terms are between you and FamilyPlate AI, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. In the event of a failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you in the app and update the "Last updated" date above. Your continued use after changes means you accept the updated Terms.
